Texas Smokable Hemp Ban

The Texas Department of State and Health Services officials have released rules entailing that the ban of retail sale, processing and manufacturing of smokable hemp products will become effective on August 2, 2020.

HB 1325 which was signed into law by Gov. Greg Abbot after the 86th Texas Legislative Session gives retailers 60 days to register their business with DSHS after the rules become effective. Registration is required to sell all hemp products.

If retailers do not comply, the enforcement process by the state agency will be like other programs in that all firms subject to enforcement will be afforded due process. Escalated enforcement could include administrative penalties or license/registration revocation, as described by DSHS.
